Guess what?! Kathleen Zellner just made a surprise filing in Steven Avery’s case! It’s been quiet for a bit but she just filed on Friday! A new witness has come forward and claims Bobby Dassey was driving Teresa’s vehicle.
Kathleen Zellner, an acclaimed wrongful conviction lawyer, has recently made a significant move in support of Steven Avery’s claims of innocence regarding the 2005 murder of Teresa Halbach, a freelance photographer for Auto Trader. In a surprising motion filed on Friday in Wisconsin, Zellner revealed new evidence involving a tow-truck driver named Thomas Buresh.
According to Buresh’s affidavit, he came forward on May 10 and disclosed that he witnessed Bobby Dassey driving Teresa Halbach’s RAV4 vehicle in the days following her tragic death. Buresh further stated that there was another individual present in the vehicle, and it was not Steven Avery. Zellner believes that this witness is crucial in substantiating Bobby Dassey’s involvement in the Halbach murder.
While Zellner tirelessly works to prove her client’s innocence and secure a new trial, Steven Avery remains incarcerated in a Wisconsin prison. Zellner maintains that Bobby Dassey, who testified as a prosecution witness, is the true perpetrator of the crime.
In his signed affidavit, Buresh confirms the accuracy of his account, affirming under oath that he is telling the truth. Zellner’s motion notifies the Wisconsin judge overseeing Avery’s post-conviction petition about Buresh’s corroboration of previous testimonies regarding Bobby Dassey’s presence behind the wheel of Teresa Halbach’s RAV4.
According to Buresh’s statement, in November 2005, he was employed as a self-employed repossession agent and encountered the vehicle in question near the Avery Salvage property and the Josh Radandt gravel pits. Buresh recalls offering the driver, who had hit a deer and had a broken headlight, a roll of duct tape for repairs. Later, while heading back north after realizing his navigation error, Buresh noticed the RAV4 driving south on County Road Q and turning left after passing him. This occurrence was unusual given the time of night, and Buresh’s tow truck’s bright lights enabled him to clearly see the occupants inside the RAV4. Buresh’s assistant, Mike, who has since passed away, also witnessed the vehicle.
Having recognized Bobby Dassey during news reports of the Steven Avery murder trial in 2006 and 2007, Buresh disclosed his observation to a Brown County detective while incarcerated but received no response. He asserts that the passenger in the RAV4 remains unidentified, but he is certain it was not Steven Avery. Buresh shared this information with his brother Ron in 2017 or 2018, emphasizing that he does not personally know any members of the Avery or Dassey families.
The affidavit concludes by stating that Buresh has not received any promises or incentives in exchange for providing this testimony.
Zellner’s motion has been submitted to Wisconsin Judge Angela Sutkiewicz at the Sheboygan County Courthouse, as well as Assistant Attorney Generals for Wisconsin, Lisa Kumfer and Tiffany Winter, who are responsible for opposing Avery’s release.
The pursuit of justice continues as Kathleen Zellner and her team diligently work to shed light on the truth surrounding Steven Avery’s case and establish his innocence.
Hopefully we start to see some rulings come down soon and move this forward. Steven has been waiting long enough Justice needs to be served and Steven and Brendan need to be released.
