If you haven’t heard, Kathleen Zellner just filed a new affidavit with the courts for the Steven Avery case and has named a new witness that has been sworn to oath that he did not see Steven Avery driving Teresa Halbach’s RAV4.

1. The individual (Thomas Buresh), worked as an independent self-employed repossession agent in 2005.

2. On the late night of November 4th or early morning of November 5th, they were driving a tow truck in Larrabee, Wisconsin, near Highway 147 and County Road Q in Manitowoc County.

3. They noticed a vehicle in the Park N Ride on Highways 147 and 43 that had struck a deer and had a broken headlight. They provided the driver with duct tape for repairs.

4. While driving on Highway 147, they made a wrong turn and ended up going south on County Road Q. After realizing the mistake, they turned around and headed back north.

5. On their way back north, they observed a RAV4 vehicle driving south on County Road Q. The RAV4 turned left after passing their tow truck.

6. The witness found it unusual to see any other cars on the road at that late hour.

7. The tow truck’s bright headlights allowed them to see the occupants of the RAV4 as it passed.

8. The witness had a helper named Mike (unknown last name) in the tow truck that night, who also noticed the RAV4. However, Mike has since passed away.

9. When watching news coverage of the Avery trial in the fall of 2006 and 2007, the witness recognized Bobby Dassey as the driver they had seen that night in 2005.

10. During November 2006, the witness was incarcerated in Brown County on a domestic charge, and again in February 2007 for bail jumping. They claim to have informed a Brown County detective about their knowledge of the Halbach murder but were ignored and told to remain silent.

11. The witness cannot identify the passenger in the RAV4, but they are certain it was not Steven Avery.

12. In 2017 or 2018, the witness informed their brother Ron about their observation of the RAV4 in 2005. They clarify that they do not personally know any members of the Avery or Dassey families but may have delivered towed vehicles to the Avery Salvage Yard on a few occasions.

13. The witness believes they may have encountered Steven Avery once at a local McDonald’s but did not have a conversation with him.

14. The witness does not know Mike Osmunson.

15. They affirm that no promises or incentives were given to them in exchange for providing this affidavit.
